📋 Terms of Service

1. Service
MijnBouwApp provides a SaaS platform for construction professionals: project management, receipt tracking, mileage registration, tax forecasting, Open Banking insight and AI analysis.
The service is for business use by persons aged 18+ (sole traders, partnerships, LLCs).
2. Account
- You are responsible for your account and password security.
- One account per business entity; reselling without permission is prohibited.
- We may suspend accounts for abuse, fraud or non-payment.
3. Payments via Stripe
Payments via Stripe, Inc. By paying you agree to Stripe Terms and Stripe Privacy. Card data is never stored on our servers.
- Subscriptions auto-renew unless cancelled before renewal date.
- EU right of withdrawal: refund within 14 days of first payment.
- Price changes announced 30 days in advance by email.
4. Open Banking (Enable Banking)
- Bank consent is voluntary and separate from the base subscription.
- You can revoke access at any time at enablebanking.com/data-sharing-consents.
- MijnBouwApp does not permanently store raw bank data; only processed summaries per project.
5. AI Services
AI via Google Gemini API and optionally OpenAI. AI outputs are indicative only — not legal or fiscal advice.
6. Data & IP
- Your data: you retain ownership; we receive a limited licence to provide the service.
- Platform: software, name, logo and design are our intellectual property.
7. Liability
MijnBouwApp is not liable for indirect damages or lost profits. Total liability is limited to amounts paid in the preceding 3 months.
8. Termination
- Cancel via Settings → Subscription → Cancel, or by email.
- After cancellation: 30-day data export window; then deletion (subject to statutory retention).
9. Governing Law
Dutch law applies. Disputes before Dutch courts. Consumers may also use the EU ODR platform.
